Not sure what legal gyrations and gymnastics will be undertaken, but something Congress and the Courts need to do is tell the EPA that carbon dioxide is not a pollutant, and further to determine what levels, if any, of CO2 emitted by an automobile explicitly contribute to what degree of global temperature change. Such a limit is not unprecedented - radiation is administer by the LNT philosophy, and is acknowledged in low doses to be benign. If EPA can regulate CO2 emissions from a car, by reason they should be able to regulate procreation, since offspring produce more CO2 emissions.
The best way, of course, it to get the government out of the automobile business and let the market decide what works and where innovation is needed.

As Americans, we have the constitutional right to travel and I know of no authority that would give Congress the right to tell Americans by what method they can travel. Socialism - Gov't controll over the economy (Simple definition). Includes health care, education & how you believe and worship.
Change is needed to get off this path. It's up to the American citizen to become more involved (vote coming up soon).
