This appears, on the surface to someone who is not a constitutional scholar, to be unconstitutional. After all, if the activity was legal when it occurred under a given regulatory framework, it seems hard to believe that taxing those activities after the fact would pass muster under our constitution. while they could certainly enact new taxes for all activities going forward, I need to be convinced that this will withstand the certain lawsuits that will come from utilities and energy companies.

In the end, I guess those companies could simply choose to exit New York, so there would be no power left and if there are no assets to collect, what would NY do?

So much can be said about the idiocy. For me I hope they pass the tax and the energy companies can show that the use of their product and services were so beneficial - they will receive a windfall tax rebate and bankrupt the states.

In reality, it is the "Gimmie Machine" at work of where entitled brats of low IQ want more money and they are coming up with idiotic ideas for money when they should address pending.
